介绍
Every freight forwarder who has handled France-bound consumer goods has seen the same scenario play out. The container arrives, the customs paperwork is in order, duties are paid, and then the consignee reports that the goods cannot be put on sale. The reason is rarely a missing certificate. More often it is a carton of retail packs whose labels, warnings and leaflets are printed in English, or in English and Chinese, with nothing in French. France is a market of roughly 68 million consumers and a gateway to the wider EU market of about 450 million, and it treats the language in which shoppers are told how to use and safely handle a product as a matter of legal protection, not decoration.
The rule behind this is the Toubon Law, officially Law No. 94-665 of 4 August 1994 on the use of the French language. It takes its name from Jacques Toubon, the Minister of Culture who proposed it, and it requires French in a wide range of settings, including official publications, workplaces, advertising and the presentation of goods and services. For anyone importing consumer products, the labelling and consumer information provisions are the ones that decide whether cargo can move from the warehouse to the shelf.
This guide explains what the Toubon Law requires in practice for imported goods, which documents are covered and which are not, how enforcement works, and how the law interacts with newer EU rules such as the General Product Safety Regulation. It then turns to the operational side, showing where in the supply chain label problems are cheapest to fix and how a forwarder such as Topway Shipping can build checkpoints into a China-to-France shipment. The content is general information for logistics and trade professionals and is not legal advice, so confirm product-specific questions with counsel or the French consumer authority.
What the Toubon Law Is and Why It Exists
Legal Background and Purpose
The Toubon Law was adopted in 1994 with three stated aims: to preserve the French linguistic heritage, to protect French consumers, and to promote French culture. Of these, consumer protection carries the most weight when a regulator looks at imported goods. The idea is simple. A person buying a hair dryer, a food supplement or a child’s toy in France is entitled to understand what the product is, how to use it and what risks it carries without needing to read a foreign language.
The law did not pass unchanged. The French Constitutional Council reviewed it in July 1994 and limited some of its reach, particularly provisions that would have forced private persons to use prescribed vocabulary in ordinary communication. The consumer-facing obligations survived. An implementing decree of 3 March 1995, Decree No. 95-240, later filled in practical details, including how translations and foreign terms may be presented. Together these texts remain the backbone of French-language labelling compliance today.
The Provisions That Matter for Imported Goods
Because the Toubon Law is triggered by marketing to consumers rather than by the physical movement of cargo, the useful way to think about it is by audience. Material that a French consumer will read must be in French. Material that only supply chain professionals will read generally does not need to be, although exceptions and practical expectations exist. The table below summarises how the main document and label types are usually treated.
| 材料 | Must it be in French?
| Retail packaging text and product labels | 是 | Product name, description, usage, precautions and any claims made to consumers should appear in French. |
The scope and conditions of the warranty must be described in French. |
| Invoices and receipts issued to consumers | 是 | Mainly relevant to retailers and online sellers, but it shapes the systems of your consignee. |
| Websites, listings and marketplace pages aimed at France | 是 | Product pages, checkout, delivery terms and returns information should be in French. |
| Advertising and promotional material | 是 | Applies to written, spoken and audiovisual advertising. |
| Shipping marks and handling symbols on outer cartons (B2B) | 一般没有 | Logistics markings are not consumer information, but retail-ready display cartons are a different case. |
English is commonly processed, though an authority may ask for a French translation of a specific document. |
| Registered trademarks and brand names | 没有翻译 | Brand names stay as registered, but descriptive text around them should be in French. |
The second point concerns customs and transport documents. A commercial invoice, packing list or bill of lading written in English is routinely processed in French ports, and forwarders and brokers work with them every day. Even so, an official body may ask for a translation of a specific document, and a mismatch between the product description on the invoice and the French description on the label can attract attention. Keeping descriptions aligned across documents saves time.
The third point is online selling. Product pages, checkout flows, delivery terms and returns policies directed at consumers in France fall under the same logic, even if the seller’s server sits outside the country. Authorities have treated sites that target French consumers, through the use of the euro, French delivery options or French-language marketing, as subject to the law. Sellers who ship from overseas warehouses to French buyers should assume their listings are in scope.
Legibility, Completeness and Accuracy
Inspectors do not simply check whether French appears somewhere on the pack. They compare what the foreign version says with what the French version says, and they examine how readable it is. A translation that omits a warning present in the original, or that renders a safety instruction in a way that changes its meaning, is treated as non-compliant. Parliamentary answers on enforcement have repeatedly noted that, while totally unlabelled imports are less common than in the past, incomplete or approximate translations remain frequent, and that legibility of the French text is a recurring breach.
Exceptions and Grey Areas
The law and its implementing decree recognise that not everything can or should be translated. Registered trademarks and brand names stay as they are. Certain foreign-named specialities and typical products, such as a traditional food known by its original name, may keep that name, although the description around it must still be in French. Internationally understood pictograms and symbols can carry part of the message, and the EU case law mentioned earlier supports their use alongside or in place of words where they are easily understood.
Several areas sit in grey territory. One is the indication of origin. Plenty of products carry a plain Made in China legend, and whether French wording such as Fabriqué en Chine is strictly required has been debated among practitioners. The cautious approach is to add the French version, particularly where the origin statement forms part of the product presentation. Another is digital instructions. A QR code leading to a French manual is a useful supplement, but regulators generally expect safety-critical information to be on the product or in the box in printed form. A third is multilingual leaflets. A booklet with twenty languages is acceptable as long as the French section is complete and easy to find, but a leaflet where French appears only as a short summary is not.
When in doubt, treat the consumer as the test. If a French reader would need English to use the product safely, the pack is not ready.
The Toubon Law rarely operates alone. Most consumer goods are also governed by product-specific EU regulations that contain their own language requirements, usually phrased as information that must be given in a language easily understood by consumers in the Member State of sale. In France, that language is French. The table below gives a simplified view of how this plays out by product category. It is a starting point for discussion with your compliance adviser, not a complete checklist.
Typical French-language content | Other regimes to check |
Manual, safety instructions, warnings, warranty and recycling information | CE marking, electromagnetic compatibility and low-voltage rules, WEEE symbol and producer registration |
| Toys and childcare items | 年龄分级、窒息警告及其他警告、使用说明 | EU toy safety rules, CE marking, importer name and address |
EU textile labelling rules, French rules on environmental claims |
Function, precautions, usage instructions, batch and expiry information | EU Cosmetics Regulation, EU Responsible Person, product notification |
EU Food Information Regulation 1169/2011, importer details, supplement-specific rules |
| Household chemicals and detergents | 危险说明、预防措施说明、使用方法 | CLP labelling rules, detergent regulation, poison centre notification |
| Packaged goods generally | Recycling and sorting instructions | French AGEC rules, Triman logo, Info-tri |
The General Product Safety Regulation, which has applied since 13 December 2024, deserves separate mention because it has changed how authorities look at non-EU products. It requires products to carry traceability information, such as a type or batch number, and to identify the manufacturer and, in many cases, an EU-based economic operator with a postal and electronic address. Safety information and warnings must be given in a language that consumers in the destination country can easily understand. For a Chinese manufacturer selling through an overseas warehouse into France, this means the label problem and the responsible-person problem are now closely connected.
France has also added its own layer through the AGEC anti-waste law, which introduced recycling marking obligations, including the Triman logo and sorting information for many packaged products. Brands that comply with the language rule but ignore this layer still find themselves facing the same inspectors.
Enforcement, Penalties and Recent Developments
Penalties and Commercial Consequences
Fines are rarely the real cost. A stop-sale order freezes inventory. Marketplaces delist non-compliant products and may suspend the seller’s account. Retail buyers can cancel orders and impose chargebacks. Goods may need to be relabelled in a French warehouse, which means storage fees, labour and lost selling days. In serious cases involving health or safety, authorities can require withdrawal or recall.
What Has Changed Recently
The enforcement climate has tightened. A compliance report on GPSR seller obligations published in August 2026 notes that the DGCCRF examined products sold on the seven foreign marketplaces most visited by French consumers and found that 46 percent of the analysed items were non-compliant and dangerous, leading to more than 100,000 products being withdrawn. That finding concerned safety more than language, but inspectors who open a box for one reason often notice the others.
Where Cargo Gets Into Trouble
In practice, language problems enter the supply chain at a handful of predictable points, and most of them have little to do with the final shipment. The first is the artwork stage. A factory builds packaging from a template designed for a different market, the buyer approves the dieline but not the text, and nobody checks whether French is on the pack until the goods are in transit. By then the only options are expensive.
The second point is mixed-market production. Brands that sell in several countries often use a pan-European pack with a dozen languages crammed into a small space. French appears, but in a font so small that it fails the legibility test, or the French text is an abridged version of the safety text. A shipper who assumes that multilingual means compliant often finds otherwise.
The third is late-added SKUs and sets. A promotional bundle or gift set combines items that individually carry French labels, but the outer pack created for the bundle is English-only. Re-orders create a fourth risk: a repeat order is produced from an older artwork file that predates a label correction, and the previously fixed error returns. A fifth appears in overseas warehouse fulfilment, where cartons are opened and units are sent directly to French consumers with an English inner leaflet.
Cross-Border E-Commerce Sellers and Marketplace Fulfilment
Cross-border e-commerce sellers face the Toubon Law in a sharper form than traditional importers, because their goods go straight from a warehouse to an individual consumer’s door with no retail buyer in between to catch mistakes. When a French customer opens a parcel and finds an English-only manual, the complaint goes directly to the marketplace, the seller or the consumer authority. There is no distributor to absorb the problem.
Parcel-level fulfilment adds another wrinkle. Where sellers ship inventory to a warehouse in the EU and then dispatch individual orders, every inner leaflet, gift insert and promotional card that goes into the parcel is also consumer-facing material. A French product page and a compliant pack mean little if the thank-you card or the quick-start guide in the parcel is English-only. A short audit of everything that physically travels with the product, not just the product itself, closes that gap.
| Fix point |
Artwork and print stage | Cleanest result, lowest unit cost, no rework | Needs early planning and approved French copy before the print run |
After production, before shipment | Corrects the problem before ocean freight, stickers or inserts can be supervised | Labour cost and possible missed cut-off or booking delay |
| At an overseas consolidation point or warehouse | 在后续发货之前 | 可灵活处理混合订单和临时变更 | Extra handling, needs a trusted partner and clear written instructions |
| At a warehouse in the EU after import | 通关后 | Useful rescue option while goods are still held | Storage costs, higher labour, risk of inspection before correction |
After enforcement action | Last resort when goods are already in the market | Fines, delisting, reputational damage, possible destruction or re-export |
In most cases the best economics come from fixing artwork before the first print run. A single approved French text file, reviewed once and reused across re-orders, removes most of the risk at almost no marginal cost. The rescue options in the lower half of the table all consume time and money that would otherwise go to inventory.
Define the Scope First
Start by identifying exactly what is being sold, to whom and through which channel. A product sold to French consumers through a marketplace needs full consumer-facing compliance. A product sold business-to-business to a professional installer may face different rules. Map the product against the categories in the earlier table and note any regulation that adds its own information duties. This takes an hour and avoids a difficult discussion later.
Translate and Validate
Make sure the French text appears wherever the English text does. If the English pack carries a claim, a warning, an ingredient list or an instruction, the French pack should carry the equivalent. Anything shorter invites the question of what was left out.
Keep the Paper Trail
Retain the approved French copy, translator confirmation, proofs, inspection photographs and the declarations of conformity relevant to the product. If an inspector visits, the ability to show that compliance was planned and checked changes the tone of the conversation. Align product descriptions across the commercial invoice, packing list, customs declaration and label, since inconsistent wording is a common trigger for questions.
How Topway Shipping Supports France-Bound Cargo
仓储, customs clearance and last-mile delivery. Topway Shipping also offers flexible full-container-load (FCL) and less-than-container-load (LCL) ocean freight services from China to major ports worldwide, which covers the routes that serve European buyers.
For importers moving consumer goods to France, the useful contribution is process discipline around the shipment. Because Topway Shipping works from the first leg through to last-mile delivery, it can raise label and documentation questions at booking, before cargo is loaded, when corrections are cheap. Shippers can use that early
The Toubon Law is not designed to obstruct importers, but it is one that importers ignore at their own cost. French must appear on labels, instructions, warranties and consumer-facing materials for goods marketed in France, the French text must be complete and at least as legible as any foreign version, and newer EU rules such as the General Product Safety Regulation reinforce the expectation that safety information reaches the consumer in a language they understand. Enforcement is carried out by the DGCCRF and related bodies, and recent surveys and reports suggest that scrutiny of imported goods is intensifying.
For shippers and forwarders, the lesson is to move the language question upstream. Settle French copy before production, inspect before loading, and keep records. Teams that do this rarely see their cargo stopped, and when problems do occur they can be corrected at a stage where the cost is measured in stickers rather than lost sales. If you are planning a France-bound shipment from China, speak with Topway Shipping early about your cargo, your routing and your compliance checkpoints, and build the French-language review into the booking rather than the rescue plan.
Q: Does the Toubon Law apply to goods that only pass through France on the way to another EU country?
Q: Can I use English labels and add a French leaflet inside the box?
A: A leaflet can cover usage information, but the product name, safety warnings and other key consumer information are normally expected to be visible on the pack or product itself. Confirm the exact position for your product with a compliance adviser.
Q: Who is responsible if the labels are non-compliant, the importer or the forwarder?
A: Responsibility rests mainly with the business that places the product on the French market, such as the brand owner, importer or seller. A forwarder is responsible for its own services, and is not normally liable for label content unless it also acts as importer.
Q: Does a Made in China marking need to be translated?
A: Practice varies and the point is debated, so the cautious approach is to add the French wording, for example Fabriqué en Chine, where the origin statement forms part of the product presentation.
